Terms of Service

1. Acceptance of Terms

By accessing or using Caricature Generator ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Service Description

Caricature Generator is an AI-powered tool that transforms photos into caricature-style artwork. The Service offers both free and paid tiers, including credit-based and subscription plans.

Important clarification: This Service is a style caricature tool only. We do NOT provide face-swap, deepfake, face replacement, or any identity manipulation services. Our AI exclusively creates exaggerated, cartoon-style artistic portraits of the same person depicted in the uploaded photo. The output is always a stylized caricature — never a realistic reproduction or identity substitution.

AI models we use: all images are AI-generated by third-party image models. The Standard, Pro and GPT Image 2 options use OpenAI GPT Image 2. The Nanobanana, Nanobanana 2 and Nanobanana Pro options use Google's Gemini image models (Nano Banana, Nano Banana 2 and Nano Banana Pro). Every option goes through the same content-safety checks described in Section 5.

3. User Accounts

You may create an account using Google OAuth. You are responsible for maintaining the security of your account. You must provide accurate information and promptly update any changes.

4. Acceptable Use Policy

4.1 Prohibited Content

You may not upload, request, or generate any of the following six categories of content:

1. Pornography / NSFW: nudity, sexually explicit or sexually suggestive imagery of anyone.
2. Violence / gore: graphic violence, injury, blood, self-harm, or content that glorifies or threatens violence.
3. Hate speech: content that attacks, demeans, or discriminates against people based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, or other protected characteristics, including extremist symbols.
4. Child-unsafe content (CSAM): any sexual or sexualized content involving minors, or any content that exploits, endangers, or harms children.
5. Deepfakes / impersonation: face-swaps, realistic fakes, or images meant to impersonate or deceive others about a real person, including public figures and celebrities.
6. Copyright / trademark infringement: content that copies copyrighted characters, artwork, logos, or brands you do not have the rights to use.

4.2 Zero Tolerance

Child sexual abuse material, non-consensual sexual imagery of a real person, and content that promotes terrorism or mass violence are removed immediately, the account is terminated, and the content may be reported to the relevant authorities.

4.3 Other Prohibited Conduct

You also agree not to:

• Upload photos of people without their permission
• Pass off AI-generated images as human-made or as real photos
• Use prompts designed to bypass our safety measures ("jailbreaks")
• Attempt to circumvent rate limits or access controls
• Reverse-engineer or exploit the Service infrastructure
• Use automated tools to scrape or abuse the Service

5. Content Moderation, Reporting & Enforcement

5.1 How We Moderate

• Prompt screening: every generation request, including the style instructions and any text you type, is checked by an automated moderation service before it reaches the image model. Requests that are flagged are refused, and if the moderation service is unavailable no image is generated.
• Image and output safety: uploaded photos and generated images pass through the built-in safety systems of the image model providers (OpenAI and Google), which refuse requests and block outputs that violate their content policies.
• AI disclosure: all images produced by the Service are AI-generated and are presented as such.

5.2 Reporting Content

To report content that breaks this policy, email support@caricature-generator.com with a description and, if possible, a screenshot. We review every report and aim to respond within 2 business days.

5.3 Enforcement

If we find a violation, we may refuse the request, delete the content, revoke remaining credits without refund, and suspend or terminate the account. Zero-tolerance violations (Section 4.2) lead to immediate termination.

5.4 Appeals

If you believe we acted on your account in error, email support@caricature-generator.com with your account email and an explanation. A person will review the decision and reply.

6. Image Ownership & Rights

You retain ownership of the photos you upload. AI-generated caricatures are provided for your personal and commercial use. However, we make no guarantees regarding intellectual property claims related to AI-generated content.

7. Image Storage & Retention

All uploaded images and generated caricatures are automatically deleted after 15 days. We do not provide permanent storage. You are responsible for downloading and saving any images you wish to keep.

8. Payments & Refunds

Payments are processed by one of our authorized resellers acting as Merchant of Record: Creem.io (Armitage Labs OÜ) or Waffo.com Limited. The reseller for your purchase is shown at checkout and on your receipt, and handles billing, tax collection, payment processing, and refunds for that order on our behalf.

Credit Packs

Credit packs are one-time purchases. Once credits are added to your account, they are non-refundable. Unused credit pack credits do not expire.

Subscriptions

Subscriptions may be canceled at any time through the customer portal. Upon cancellation, you retain access until the end of the current billing period. No partial refunds are provided for unused time within the current period. Monthly credits granted under a subscription are valid only within the current billing period and do not carry over to the next period or remain after cancellation.

Refund Policy

• Refund requests should be sent to support@caricature-generator.com within 7 days of purchase
• Refunds may be granted if the Service was materially unavailable or failed to deliver the described functionality
• The Merchant of Record that processed your order may issue a refund to prevent a chargeback
• Chargebacks may be initiated by customers at any time through their payment provider

9. Free Tier Limitations

Anonymous users receive a limited number of free generations each week. Registered free users receive additional weekly generations. Weekly limits reset every Monday at 00:00 UTC. These limits may be adjusted at any time without notice.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice.

11. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

12. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
